New Legal Permanent Resident Request Procedure

There is now a new procedure for those international scholars and staff who may be interested in changing their legal status to one of legal permanent residency. In some cases, the hiring UTSA organization will decide to sponsor the international employee for permanent employment authorization.

UTSA colleges, departments, and institutes are increasingly attracting international job applicants and hiring more foreign national faculty and staff members.

The complexity of the permanent residency petitions requires expertise of an immigration attorney. We have established a contract that will allow UTSA to outsource all permanent residency requests to highly competent, outside legal immigration counsel.

Effective immediately, departments desiring to sponsor a foreign national for permanent residency must first complete and submit a UTSA Legal Permanent Residency request form.

  1. The form must be reviewed , approved and signed by the sponsoring department chair and the college dean (or Vice President, if applicable).
  2. The request form is then forwarded to the Executive Vice Provost/Senior International Officer via the Office of International Programs for final approval, and subsequent referral to outside counsel by the Office of International Programs.  Once referred, the sponsoring department will be contacted by the outside law firm to immediately begin processing the petitioner’s permanent residency petition.

This service will cost hiring departments $3,500 per Legal Permanent Residency petition (EB1 and EB2). 

NOTE: The department sponsoring the international scholar for permanent residency will be responsible for payment of this standard legal fee.  This $3,500 fee is for attorney costs and services.  It does not include the additional federal application processing fees required to be paid to the United States Citizenship and Immigration Service (USCIS).

Tax Worshop Event and Updated Forms

Be sure you know how to file your taxes!

TheUTSA Payroll Office and the Office of International Programs will offer a tax workshop for international students, faculty and staff who are at UTSA on non-immigrant visas.taxes istock

This workshop will help explain the forms needed, how and when to file, and other insights. The workshop will be held on 2-5 p.m., Thursday, Feb. 28, 2013, in the University Room (2.06.04) in the Business Building on the Main Campus.

International students, faculty and staff are required by law to file:

  • Internal Revenue Service (IRS) Form 8843 (Statement for Exempt Individuals)
  • 1040NR-EZ (U.S. Income Tax Return for Certain Nonresident Aliens With No Dependents) or
  • 1040NR (U.S. Nonresident Alien Income Tax Return).

All F-1 and J-1 visa holders who are considered nonresident aliens for tax purposes and who had no income during 2012 must file Form 8843 by June 15, 2013.

For those who earned income in the United States during 2012, income tax returns must be filed by April 15, 2013.

Failure to properly file these forms each year can cause problems with an international student’s immigration status.

No registration is needed.

Always be sure to check the International Gateway Scholar Forms page to be sure you have the most up-to-date form for your Scholar Services requests. We often are required to make changes to more accurately represent changes in immigration regulations. These alterations are often subtle changes; be safe and download the forms directly from our website to be sure you are using the correct version.

UTSA’s Office of International Programs/Scholar Services will be periodically sending out updates as new forms, information, and regulations become available. New TN Request Available

We’ve added a new TN visa request form. This visa request is for scholars and professionals who are citizens of either Mexico or Canada. It does not apply to any other citizenship categories.

Updated H-1B Worksheet for New Non-Immigrant Workers to Complete

We’ve revised the checklist on the H-1B form that prospective employees must complete. Please be sure to use this new form in future requests.
